Theses cases involve claims for the decedent’s pain and suffering, lost wages, and medical expenses incurred prior to the death. More importantly, wrongful death claims involve recovery for the decedent’s beneficiaries, who most often include spouses, parents, children, and other family members for the losses they have suffered because of the decedent’s death. Recovery includes compensation for damages such as reasonably expected support and services, as well as the loss of the decedent’s society, companionship, consortium, guidance, love, and affection, which can often times be difficult to quantify. Unlike general negligence law, if the decedent’s death is caused by the willful, wanton or reckless misconduct, or gross negligence, the beneficiaries may also be entitled to recover punitive damages.
