Premises liability is the area of law that requires that a person in possession or control of property or building(s) maintain such property in a reasonably safe condition, keeping it free from dangers and defective conditions that can cause injury to others. The owner/occupier of land or a building has a duty to exercise reasonable care in the management of the premises to ensure that persons are protected from unreasonable risk of harm. Typically, the owner of the property, such as a homeowner, is the person responsible for injuries caused by negligent maintenance of the property. However, particularly with commercial property, the party responsible for maintaining the property in a reasonably safe condition could be the owner, a landlord, a property manager, or a tenant. Sometimes all of these parties bear some responsibility. Sometimes contractors and others who perform maintenance, repairs, snow removal or other services share responsibility. In most cases, the responsible party, including residential homeowners, will have liability insurance. There may also be medical payments insurance coverage.
